CLEAN CHI ORGANIZING CONTRACT AND SERVICE AREA

Thank you for choosing Clean Chi Organizing, LLC to improve the chi in your home!  Clean Chi Organizing, LLC aims to help you regain control and find peace in your living space. Before we begin work together, it is important to review the following terms, as it is helpful when both parties are clear on expectations. Listed below are the terms of service that define our process and service.  


This Service Agreement (the “Agreement”) is between Clean Chi Organizing, LLC (the “Company”) and the undersigned (the “Client”) about the Company’s service(s) to be performed at the Client’s stated location (the “Service Location”).


Confidentiality 

The Client’s identifiable information shall never be disclosed without the Client’s written consent except as required by law, or where a situation poses real harm to the Company’s organizers or to others.


The personal information of and in possession of the Client will be treated confidentially and with respect.  During our service, we may come across items of a private or personal nature.  It is our policy and is strictly enforced that no personal or private information is ever shared with anyone else.  

Payment Terms 


Payment is due one week after services are rendered.  


Payments can be made in the following ways: 


Cash – paid directly to the Organizer on site
Check – paid directly to the Organizer on site

Invoices are emailed the day the work is performed unless multiple days are scheduled within the same week.  In the case of multiple appointments within the week, invoices will be emailed on Friday.  

The agreed rate is $50 per hour. This rate expires at the time regular scheduled appointments cease. 


Returned checks or declined charges will incur a return fee of $50 payable to Clean Chi Organizing, LLC and the same reserves the right to deny future services, require cash payments or pay-in-advance terms if such an event occurs.  If payment is not made, including any additional return fees, within 30 days we reserve all rights to seek compensation due in court or may turn delinquencies to collection agencies as we see fit.


Process Ownership 


Regarding the editing, sorting, and organizing of items, the Client maintains process ownership.  Clean Chi Organizing, LLC recognizes items as the sole property of the Client, and though efforts will be made to help reduce the volume of belongings, when necessary, it is hereby stated that the final decision on such matters belongs to the Client. 


Project Outcomes 


Project outcomes depend on the Client’s willingness to participate in the process; sorting, editing, and donating when necessary. Long-term maintenance of organization hinges on the Client’s commitment to maintaining the order, and quantity of items in the space.


Supplies and Shopping Assistance 


Clean Chi Organizing, LLC will either make suggestions about suggested supplies to be purchased and the Client will complete the shopping OR per the Client’s request, Clean Chi Organizing, LLC will shop for and purchase the supplies, making certain they are delivered to the Client’s location.  Clients are responsible for all agreed-upon supplies (file folders, labels, shelving, containers, hooks, etc.) necessary for completion of the project and the fee for shopping and returns.  The standard hourly rate, as stated on the website, will apply for all shopping and returns.  Receipts for funds spent on Client’s behalf will be presented with the invoice. 

Cancellation Policy 


Due to the high demand in our business, a last-minute cancellation often results in lost income and time for the Organizer.  Due to this irreplaceable loss, we require a minimum of 48-hours notice of cancellation.  


Any appointments cancelled within fewer than 48-hours prior to appointment time will incur a cancellation fee of $50.  

No show appointments will incur at $100 fee, regardless of the number of hours scheduled.

Hands-on organizing sessions begin at the scheduled time, regardless of if the Client is delayed.


Clean Chi Organizing, LLC reserves the right to waive fees for special circumstances as determined by management.  To do so is at the sole discretion of management and does not in any way alter or waive any portion of this Agreement.  We do, however, understand that emergencies happen and therefore allow each client one grace pass per calendar year to reschedule without penalty.  There is no grace pass for no-show appointments.  


If late cancellations or no-shows become routine, Clean Chi Organizing reserves the right to expect payment in advance for entire session or refuse future services altogether. 

Disruption of Service/Right to Refuse Service


Clean Chi Organizing, LLC reserves the right to refuse or terminate this Agreement for the following reasons:

  • Repeated cancelations and rescheduling 

  • Client or family members engage in disruptive, threatening or violent behavior, which can include but is not limited to yelling, verbal abuse, threats (outright or implied)

  • Non-payment 

  • Unsafe, unsanitary, and/or hazardous working conditions 



Liability


The Client agrees that Clean Chi Organizing, LLC shall not be responsible for any damages (whether compensatory, direct, indirect, actual, special, punitive, incidental, consequential or otherwise), any losses (whether loss of or damage to property, loss of data, loss of use, loss of income or profit, or loss of any kind), personal injury, claims of third parties, or other claim or liability of any kind, including those resulting from discarding or destroying of any personal property or records (physical, digital, or otherwise) unless gross negligence or intentional damage has been proven. The Client is responsible for providing a list of valuables to the Company of particular concern.

Items for Disposal or Donation


Clean Chi Organizing will transport items for disposal or donation to the appropriate locations.  Whether by donation, recycling, shredding, or trash, should Clean Chi Organizing, LLC take items, they may dispose of said items at their sole discretion.  Client may elect to dispose of items personally as well. 


Service Area

The Company services the Chicago suburbs unless otherwise agreed upon in writing.  Any suburbs within 10 miles from Itasca, IL is considered within the service area and travel is included in the hourly rate.  (Suburbs included but not limited to: Elk Grove Village, Addison, Medinah, Wood Dale, Villa Park, Elmhurst, Bensenville, Scahumburg, Hanover Park, Glendale Heights, Hoffman Estates, Arlington Heights, Mt. Prospect, Des Plaines, Bloomingdale, Roselle, Carol Stream, Wheaton, Glen Ellyn, Lombard) Travel time to and from suburbs between 11-15 miles from Itasca is an additional $15.  Travel beyond 15 miles one way is an additional $30.   Travel fees may be waived at the sole discretion of management.  


Time of Performance 


Clean Chi Organizing, LLC employees and contractors do their best to complete the work in a timely manner, however, all parties agree that time is not of the essence to complete any agreed upon work.  While we do our best to work expediently, we also take into consideration the Client’s emotional, physical, and mental needs as well as the cleanliness of the area to be organized.  We will adjust our speed of work for the best interest of the Client. If any provision of this contract is held unenforceable, then such provision will be modified to reflect the parties’ intention. All remaining provision of this contract shall remain in full force and effect.  

Photo Release


The Client releases all rights to before and after photos, to be used by Clean Chi Organizing, LLC for marketing purposes, including but not limited to website, social media, educational presentations, and pamphlets. Client identity and confidentiality will always be top priority in regard to photo usage. 


Customer Satisfaction Policy

NOTE: For hands-on Organizing Sessions only, not Consultations

The Company strives to achieve 100% customer satisfaction. Should the Client be dissatisfied with the service(s) provided, the Client agrees to submit a written statement of issues and, in good faith, allow the Company to make reasonable efforts to resolve the issue(s). Such statements must be mailed to the Company by registered mail and postmarked within two (2) days from the date of the service in question. Failure to do so within that time implies that the Client fully accepts the work.

Other Service Providers


If other service providers will be involved, the Company takes no responsibility – and the Client agrees to hold the Company harmless – for their actions or performance.


Governing Law


This Agreement is governed by the laws of the State of Illinois and is not transferable to any other party or service location. The Client agrees to the personal jurisdiction of the state and federal courts in DuPage County, Illinois, U.S.A.


I have read, understand, and fully agree to the above terms and understand and agree that the services are being performed in accordance with the above items. By scheduling organizing services, I am agreeing to these terms.
